Aviator LLC Wins $330 Million in Lawsuit Against Spribe and Adjarabet

Aviator LLC won a lawsuit against Spribe and Adjarabet, which used the Aviator name and logo on their products. As a result of this lawsuit, the defendants were ordered to pay $330 million in damages and to cancel their trademarks that infringed the plaintiff's copyright.

Aviator LLC Alleges Infringement of Its Copyright

Aviator LLC owns several registered trademarks featuring the Aviator image and name for use in the gambling industry. However, Spribe, known for its popular "crash" game, has used the same brand for its products. In 2021-2022, Spribe registered its Aviator trademarks for computer games and gambling services, which is the reason for the lawsuit.

The Aviator game is a "crash" game where players can place bets while watching a virtual plane fly. The longer the plane flies, the higher the bet multiplier becomes, and the more money players can earn. However, if the plane flies away before the player withdraws their bet, the bet is lost.

This simple yet addictive concept has gained popularity among players around the world. However, this did not stop Aviator LLC from filing claims, claiming that their copyrights were infringed.

The court upheld Aviator LLC

Aviator LLC filed a lawsuit against Spribe, seeking to cancel the latter company's trademarks, arguing that the marks were registered in bad faith, knowing that Aviator LLC's rights existed. In addition, the plaintiff claimed that the registration of these trademarks infringed its copyright in the Aviator image.

As part of the lawsuit, Aviator LLC also sought to prohibit Adjarabet from using the Aviator name and image and to collect damages from them.

On August 20, 2024, the Court of First Instance ruled in favor of Aviator LLC. The court satisfied the plaintiff's claims, canceling the Spribe trademarks and obliging Adjarabet to pay compensation in the amount of $330 million to the company.

Nikoloz Gogilidze, Managing Partner of the law firm Mikadze Gegetchkori Taktakishvili, which represented the interests of Aviator LLC, noted that his team and their client are pleased with the outcome of the lawsuit. According to him, the firm will continue to actively protect the intellectual property of its clients from unauthorized use on international gaming platforms.
