Aviator LLC has initiated proceedings to challenge Spribe OU’s registered rights in the European Union for its popular casino game Aviator. In August, the company won a $330 million trademark and copyright judgment against Spribe OU and Flutter’s Adjarabet in a Georgia trial court.
As a result of the lawsuit, Aviator LLC has disclosed additional details about the origins of its brand and logo, while Spribe OU and Flutter Entertainment have defended their actions in using the game name and logo. However, Aviator LLC has now filed a new application with the European Intellectual Property Office (EUIPO), based on the same grounds as in the Georgian court.
In its new claim, Aviator LLC claims that Spribe OU “registered the contested trademarks in bad faith” and claims to have infringed the company’s copyright in the European Union.
The difference between this case and the Georgian one is that the contested trademark (EUTM) is registered for goods and services in classes 09 and 41, which cover software as well as gambling services, including online casinos.
Mikadze Gegetchkori Taktakishvili LLC, the law firm representing Aviator LLC, reports that Managing Partner Nikoloz Gogilidze noted: “The actions in the EUIPO are a logical continuation of this dispute following the court’s decision. Our client is determined to actively protect its intellectual property rights worldwide. Therefore, after gaining an initial victory in Georgia, where the initial infringement occurred, the next step will be to challenge Spribe OU’s trademarks internationally.”
Also, in other legal news, the Malta Gaming Authority (MGA) has suspended Goldwin’s gambling license following regulatory breaches.
