FanDuel's Battle Against New York Advertising Rules
In a surprising turn of events, FanDuel Group has been revealed to have lobbied against new advertising rules in New York State. The regulations, introduced in October, aimed to restrict sports betting advertisements near educational institutions. However, unredacted documents disclosed by the New York State registrar shed light on FanDuel's resistance to these measures.
Disagreement on College and University Campus Advertisements
Dated October 18th, the documents unveiled FanDuel's objection to advertising bans near college and university campuses. The company argued that the restrictions could extend to unaffiliated residential and commercial areas bordering these campuses. Nevertheless, the New York State Gaming Commission defended its stance, asserting that such advertising could be seen as "objectionable marketing" and could potentially lure underage individuals into gambling.
FanDuel's Opposition to Other Regulations
FanDuel's opposition extended beyond campus advertisements. The operator voiced concerns about compulsive-play-assistance messaging in ads, arguing that it should be limited to the website to avoid clutter. They also raised the issue of becoming non-compliant with marketing in other states if New York rules changed.
The Commission's Response
In response, the Commission maintained that these requirements were not inconsistent with state law and emphasized the need for appropriate regulation of betting ads in New York.
Debates Over Keywords and Daily Fantasy Sports
FanDuel also disagreed with restrictions on keywords targeting problem gamblers and the classification of daily fantasy sports as sports betting. The Commission argued for the importance of responsible advertising and said it would evaluate cases individually before imposing penalties.
Additional Concerns and FanDuel's Market Leadership
FanDuel's concerns encompassed independent testing laboratory certifications and anti-money-laundering requirements. However, the Commission dismissed these appeals.
Despite these regulatory debates, FanDuel continues to dominate the New York online sports betting market, posting record-high handles and revenues for November. This revelation comes at a time when New York witnessed a surge in online sports betting, setting new records for betting volumes and revenue.
